1. Acceptance of Terms

Welcome to Gacha.DIY. By accessing or using our website, Discord bot, or any other features, content, or applications offered by Gacha.DIY (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our Services. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Services constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use our Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services. Please have them read these Terms with you.

By using the Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all the provisions of these Terms.

3. Account Registration

To access certain features of the Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable your account if you violate these Terms or if we determine, in our sole discretion, that your account activity is suspicious or potentially harmful to the Services or other users.

4. Discord Bot Integration

Our Services include a Discord bot that can be added to Discord servers. By adding our bot to a server, you confirm that you have the necessary permissions to do so and that you agree to these Terms on behalf of the server members who will interact with the bot.

The bot will only collect and process data necessary for its functions, as described in our Privacy Policy. Server administrators are responsible for informing their members about the bot's presence and functionality.

We reserve the right to remove our bot from any server at our discretion, particularly if we determine that the server is being used for purposes that violate these Terms or Discord's Terms of Service.

5. Gacha System and Virtual Items

Our Services include a gacha system where users can collect virtual items through various means. These virtual items are for entertainment purposes only and have no real-world value or monetary worth.

We do not guarantee the availability of specific items or packs, and we reserve the right to modify, add, or remove items or packs at any time without notice.

Drop rates for items are determined by the pack creators and may vary. While we encourage transparency about drop rates, we do not independently verify the accuracy of creator-specified drop rates.

You acknowledge that all virtual items, points, and currencies in the Services remain our property. Your account does not confer any ownership rights to these virtual items.

6. Content Creator Responsibilities

If you use our Services as a content creator to create and distribute gacha packs, you acknowledge and agree to the following:

  • You will not create content that infringes upon any third-party intellectual property rights.
  • You will not create content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, or otherwise objectionable.
  • You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, and display your content in connection with operating and providing our Services.
  • You are responsible for ensuring that your content complies with all applicable laws and regulations, including those related to gambling or games of chance in jurisdictions where your content is accessible.

7. Payments and Refunds

We may offer the ability to purchase points or virtual items for use in our Services. All purchases are final and non-refundable unless otherwise required by applicable law.

Prices for points or virtual items are determined by us and may change at any time. We will notify users of any price changes before they take effect.

If you are a content creator receiving payments through our platform, you are responsible for complying with all applicable tax laws and regulations. We may withhold payments if required by law or if we believe in good faith that your activities violate these Terms.

8. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal purpose or in violation of any local, state, national, or international law.
  • Harass, abuse, or harm another person, including sending unwelcome communications to others.
  • Impersonate or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Services or servers or networks connected to the Services.
  • Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services.
  • Use any robot, spider, site search/retrieval application, or other automated device, process, or means to access, retrieve, scrape, or index any portion of the Services.
  • Circumvent or attempt to circumvent any technological measure implemented by us to protect the Services or prevent or restrict access to the Services.
  • Create, distribute, or use cheats, automation software, bots, hacks, mods, or any other unauthorized software designed to modify the Services.

9. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Gacha.DIY, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

10. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER Gacha.DIY NOR ANY PERSON ASSOCIATED WITH Gacha.DIY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

WITHOUT LIMITING THE FOREGOING, NEITHER Gacha.DIY NOR ANYONE ASSOCIATED WITH Gacha.DIY REPRESENTS OR WARRANTS THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

12. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL Gacha.DIY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
